The case involved a union president who published on union letterhead, a letter to a number of persons, including government officials, about the comments made by a disabled and retired Corrections Officer before a County Legislature, during a public comment period. The Corrections Officer felt that certain statements contained in the letter were defamatory (libel). Attorney Pascazi sued for defamation per se on behalf of the client.
After nearly one year of litigation, the union president and the union itself, who were both sued, settled with the client, paid the client money, and issued a clarification/apology letter to all of the people who received the initial letter.
The client is happy that his reputation has been restored, and that the union and the union president “saw the light”, and paid the client to end the litigation.
Should you, a loved one or a friend find yourself/himself/herself the target of defamation (libel or slander) or be accused of defaming another, seek competent legal advice as soon as possible.
The law concerning Defamation is complex, particularly in light of the free speech guaranty of the 1st Amendment, and requires a good experienced lawyer to address. Attorney Pascazi would also like to hear about it. Pascazi Law Offices PLLC represents persons that are accused of defamation (as Defendant) or that are defamed (as Plaintiff).
